Berkowitz Oliver Partners Jim Eisenbrandt and Christina DiGirolamo Obtain Significant Victory in Kansas Supreme Court

The Kansas Supreme Court dismissed a grand jury indictment that Jim Eisenbrandt and Christina DiGirolamo Wahl argued had violated their client’s right against self-incrimination.  The Kansas Supreme Court also found that grand jury testimony from a Kansas Bureau of Investigation special agent was wrongfully prejudicial.  By its 33-page decision, the Kansas Supreme Court overturned the 2011 holding of the Kansas Court of Appeals. Berkowitz Oliver Obtains Preliminary Injunction For H&R Block

On February 19, Judge Phillips in the United States District Court for the Western District of Missouri granted a preliminary injunction over former tax preparers who were violating their restrictive covenants, including noncompete and nonsolicitation agreements, by competing with H&R Block in and around Denver, Colorado.  The Order enjoins the former tax preparers from numerous activities, including violating the terms of their agreements with H&R Block, preparing income tax returns within a 50-mile radius of numerous locations in the Denver …

In the week of January 20, 2014, Laura Brooks and John Kemp successfully defended a major automobile manufacturer in a breach of written and implied warranty case.  Plaintiff alleged that her car’s touch screen and cell phone syncing features were defective when the she purchased the vehicle and that the defendant was unable to repair the alleged defect in a reasonable number of attempts.  Mr. Kemp and Ms. Brooks put on expert testimony to refute these allegations.
